These Terms govern your use of the TradiBot service. By creating an account, subscribing, or using the service, you (the business identified on the account, "you", "Customer") agree to these Terms and to our Privacy Policy, which forms part of them. If you do not agree, do not use the service.
TradiBot is an AI-powered phone answering and lead-capture tool. You forward calls from your business number to a TradiBot phone number; an automated AI assistant answers, collects the caller's details and enquiry, and delivers the resulting lead to you via your dashboard and, where enabled, SMS. Features may change as the service develops; we will not materially reduce core paid functionality mid-billing-period without notice.
You warrant that: (a) you are at least 18 and authorised to bind the business named on the account; (b) the information you provide is accurate and kept current; (c) you will keep your login and sign-in links secure. You are responsible for all activity under your account.
The service is a lead-capture tool only. It must not be used for, or relied on for, emergency, medical, safety-critical or time-critical communications. The AI assistant cannot call 000, dispatch help, or guarantee that any call is answered or any message delivered. You must not forward any phone line to TradiBot where a missed or mis-handled call could endanger life, health, safety or property, and you must maintain an alternative means of being reached for urgent matters. You accept full responsibility for your decision to forward any line to the service.
The assistant is an automated AI system, not a human. AI systems can mishear, misunderstand, omit, or record details incorrectly, and calls can fail to connect for network reasons. We do not warrant that every call will be answered, that every lead will be captured, or that captured details (including names, phone numbers, addresses and job descriptions) are accurate or complete. You must independently verify lead details with the caller before relying on them (for example before travelling, quoting, ordering materials or scheduling work). To the extent permitted by law, you assume the risk of missed calls and lead errors.
You must, and you warrant that you will:
(a) comply with all applicable laws in your use of the service, including Australian Consumer Law, privacy law, and the surveillance/listening-devices and call-recording laws of the state or territory where you and your callers are located;
(b) where required by applicable law or good practice, inform your callers (for example on your website, voicemail or advertising) that calls may be answered by an automated assistant and handled as described in our Privacy Policy — the assistant identifies itself as automated, but compliance for your business line remains your responsibility;
(c) use captured leads only to respond to the caller's enquiry and for your ordinary related business purposes, and comply with the Spam Act 2003 (Cth) and Do Not Call Register Act 2006 (Cth) in any further contact;
(d) configure and pay for call forwarding with your own carrier.
You must not use the service: for any unlawful, fraudulent, deceptive or harassing purpose; to impersonate another business; for lines offering medical, legal, financial or other regulated advice; to collect information from children; to probe, overload, reverse-engineer or interfere with the service; or to resell, sublicense or white-label the service without our written agreement. We may suspend accounts immediately where we reasonably believe this section is breached.
Plans and pricing are shown at purchase and bill monthly in advance in AUD via our payment provider. Unless stated otherwise, prices are inclusive of GST where GST applies. If a payment fails we may retry it and suspend the service until paid. You can cancel any time, effective at the end of the current billing period; amounts already paid are non-refundable except as required by law (including the Australian Consumer Law). We may change pricing with at least 30 days' notice, effective from your next billing period. Any free, trial or beta access is provided "as is", may be modified or withdrawn at any time, and carries no service commitment beyond rights that cannot be excluded by law.
The service depends on third-party providers (including telephony, AI processing, hosting and payments) and on the public telephone network, none of which we control. We aim for high availability but provide no uptime guarantee and may suspend the service for maintenance, security or legal reasons. We are not responsible for failures, delays or outages caused by third-party providers, carriers, your device or connection, or events beyond our reasonable control (see clause 14).
Leads captured for your business are yours. We handle personal information as described in our Privacy Policy. On account closure we will, on written request made within 30 days, provide an export of your leads, after which we may delete your data in accordance with the Privacy Policy and our legal retention obligations.
We own the TradiBot software, systems, brand and all improvements. You receive a non-exclusive, non-transferable, revocable right to use the service while subscribed and compliant with these Terms. You must not copy, modify, scrape, reverse-engineer or create derivative or competing services from our systems. Feedback you give us may be used by us without restriction or payment.
To the extent permitted by law, you indemnify us against loss, damage, cost (including reasonable legal costs) and liability we suffer arising from: (a) your breach of these Terms or of applicable law; (b) your use of leads or contact with callers; (c) your failure to meet the obligations in clauses 4, 6 or 7; or (d) claims by your callers relating to your business's goods, services or conduct. This clause does not apply to the extent the loss is caused by our own negligence or breach.
Australian Consumer Law: nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded. Where our services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for breach of a non-excludable guarantee is limited, at our option, to re-supplying the services or paying the cost of re-supply.
Otherwise, to the maximum extent permitted by law: the service is provided "as is"; we exclude all implied warranties; we are not liable for indirect or consequential loss, loss of profit, revenue, business, opportunity, goodwill or data — including loss arising from a missed call, an unanswered call, an inaccurate or incomplete lead, or a period of downtime; and our total aggregate liability for all claims in any 12-month period is limited to the fees you paid us in the 3 months before the first event giving rise to liability (or AUD $100 if you paid nothing). Each party's liability is reduced proportionately to the extent the other party's acts or omissions contributed to the loss.
Neither party is liable for delay or failure caused by events beyond its reasonable control, including telecommunications or power failures, third-party platform outages, natural disasters, government action, or denial-of-service and similar attacks — except that nothing relieves you of an obligation to pay for services already provided.
You may cancel at any time via your account or by written notice. We may suspend or terminate your account: immediately for material breach (including clauses 4, 6, 7), non-payment, or where required by law or a provider; otherwise on 30 days' notice. On termination your right to use the service ends; clauses that by their nature survive (including 10–13, 16–18) survive.
Before starting court proceedings (except urgent injunctive relief), the parties will attempt in good faith to resolve any dispute by negotiation for 30 days after written notice of the dispute. These Terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of Victoria.
We may update these Terms. For material changes we will give account holders at least 30 days' notice by email or dashboard notice; continued use after the effective date is acceptance. If you do not agree, cancel before the effective date.
These Terms and the Privacy Policy are the entire agreement and replace prior discussions. You may not assign your rights without our consent; we may assign to a related body corporate or as part of a business sale with notice. A failure to enforce a right is not a waiver.
